By using the Service provided by PixelMeshHub, you have expressed your acceptance of our Terms of Use, and agreed to be bound by the terms and conditions as described hereunder.
REGISTRATION OBLIGATIONS
Prior to using the Service, you may register with PixelMeshHub via the provided Registration Form and shall:
(a) Provide true, accurate, current and complete information (“Registration Data”) about yourself as prompted by the Registration Form.
(b) Maintain and promptly update the Registration Data to keep it true, accurate, current and complete.
USER ACCOUNT, PASSWORD AND SECURITY
Upon completing the Service’s registration process, you will be designated an account with a password. You are responsible for maintaining the confidentiality of the password and/or account and are fully responsible for all activities that occur under your account. You agree to:
(a) Notify PixelMeshHub of any unauthorized use of your password and/or account or any other breach of security, and
(b) Ensure that you exit from your account at the end of each session.
PixelMeshHub cannot and will not be liable for any loss or damage arising from your failure to comply with this security measure.
USER CONDUCT
You acknowledge that all text, information, data, software, photographs, graphics, video, music, sound, messages or other materials (“Content”), whether privately transmitted or publicly posted, are the sole responsibility of the person from which such Content originated. This means that you are entirely responsible for all Content that you upload, post, email, transmit or otherwise make available via the Service.
As PixelMeshHub does not pre-screen all the Content posted via the Service, it does not guarantee the accuracy, integrity or quality of such Content. You also understand that by using the Service, you may be exposed to Content that is indecent, offensive, objectionable or otherwise unsuitable. PixelMeshHub will not be liable in any circumstance for any Content, including but not limited to errors, omissions, or any loss or damage incurred from the use of any Content made available via the Service.
You shall not use the Service to:

Upload or share any unlawful, abusive, harassing, harmful, threatening, defamatory, obscene, vulgar, invasive, hateful, or objectionable content;

Upload or share any Content you do not have rights to;

Upload any Content that infringes upon the intellectual property rights of others;

Upload viruses or any other software designed to disrupt or damage the Service.
PixelMeshHub reserves the right, though not the obligation, to reject or remove any Content in its sole discretion, especially if it violates these Terms of Use.
PixelMeshHub may preserve or disclose Content to:

Enforce these Terms,

Comply with legal processes,

Respond to claims of rights violations,

Protect PixelMeshHub, its users, and the public.
LICENSE OF PURCHASED CONTENT
As a result of a legitimate license or a free download, any transmission of content from a registered PixelMeshHub user to a third party shall apply the following terms:

The Vendor retains, subject to any license agreement, ownership of copyrights and all other rights in the Asset purchased or downloaded via PixelMeshHub.

License rights (including 3D models, images, textures) are contingent on the actual transfer of payment. If the payment is reversed or incomplete, all license rights terminate immediately.

The Vendor grants to the third party a non-exclusive, non-transferable, worldwide, royalty-free license to publicly display or perform the purchased content.

Redistribution or resale of any content from PixelMeshHub, whether free or paid, is strictly prohibited. If content is returned, all license rights are revoked.
RETURNS

Intangible Goods: Refunds may be issued at the sole discretion of PixelMeshHub or the Vendor. Buyers must first work with the Vendor. If a refund is issued, all copies of the product must be deleted and may not be distributed.

Tangible Goods: Opened products cannot be returned unless defective. If a warranty exists, products may be exchanged or returned. If not, PixelMeshHub may provide refunds within 7 days of receipt. Original shipping costs are non-refundable. A 15% restocking fee applies.
SUPPORT OF PURCHASED ASSETS
Each Vendor is responsible for providing support for their own products. Support should be requested via PixelMeshHub internal messaging system.
INDEMNITY
You agree to indemnify and hold PixelMeshHub and its affiliates, officers, employees, and partners harmless from any claims, costs, or liabilities arising out of:

Your submitted content,

Your use of the Service,

Your breach of these Terms,

Your violation of any third-party rights.
USE AND STORAGE
PixelMeshHub is not responsible for the deletion or failure to store any Content. It reserves the right to change usage limits and practices without notice.
SERVICE MODIFICATIONS
PixelMeshHub reserves the right to modify or discontinue the Service at any time, with or without notice, and shall not be held liable for any such changes.
TERMINATION OF ACCOUNT
PixelMeshHub may terminate your account without prior notice for reasons including (but not limited to):

Violations of these Terms,

Legal compliance,

Your request for deletion,

Technical or operational issues,
-
Prolonged inactivity.
Termination includes deletion of your account, associated data, and access to the Service. PixelMeshHub shall not be liable for such termination.
DISCLAIMER OF WARRANTIES
YOU AGREE THAT:

The Service is provided “as is” and “as available”.

PixelMeshHub disclaims all warranties, express or implied, including fitness for a particular purpose.
PixelMeshHub does not guarantee:

That the Service will meet your expectations,

That it will be uninterrupted or error-free,
-
That downloads or results will be accurate or reliable,
-
That issues will be corrected.
You download and use materials at your own risk.
No advice or information from PixelMeshHub shall create any warranty.
LIMITATION OF LIABILITY
IN NO EVENT SHALL PIXELMESHUB BE LIABLE FOR:

Any indirect, incidental, special, or consequential damages,

Loss of profits, data, or goodwill,

Costs of substitute goods or services,
-
Unauthorized access to or alteration of transmissions,

Conduct of third parties,
-
Any other matter related to the Service.
GOVERNING LAW
These Terms of Use shall be governed by and interpreted in accordance with the laws of England and Wales. Any disputes shall be resolved by the courts of England, with exclusive jurisdiction.
All legal communications must be made in writing (emails are acceptable).
TERMS OF USE AMENDMENT
PixelMeshHub reserves the right to modify these Terms of Use at any time with or without prior notice.
